What Are The Consequences Of A Sexual Assault Conviction?
There are two levels of sexual assault in Massachusetts: indecent assault and battery, and aggravated sexual assault. There are several categories of indecent sexual assault and battery, depending on the identity of the victim:
- Whether the person is older or younger than 14
- Whether the person has an intellectual disability or long-term physical disability
- Whether the person has an age-related infirmity
A conviction for sexual assault against a person older than 14 has a maximum penalty of 5 years in prison. Otherwise, the maximum sentence possible is 10 years in prison, with a minimum sentence of 5 years if the victim is intellectually disabled. The defendant may also be required to be on the sex offenders registry.
Aggravating factors include whether the person required medical attention, if the touching involved a child younger than 14, if it occurred during the commission of certain felony crimes, or if the defendant is considered to be a mandatory reporter (e.g., a teacher). If the victim is under 14, aggravated indecent assault and battery results in a sentence of 10 years to life.
