Reckless Operation of Motor Vehicle

Client, a 30 year-old man, was driving home in his company van when he came to an abrupt stop behind another car stopped at a red light. When a police officer signaled for Client to pull over, Client instead allegedly fled the scene and struck the officer with his side-view mirror. Client hired the Yannetti Criminal Defense Law Firm to represent him at his arraignment. Today, Attorney Tanis Yannetti persuades the prosecutor and the judge to dismiss the criminal charge upon the payment of court costs. Further, Attorney Yannetti persuades the prosecutor and the judge to allow Client a “Not Responsible” finding on the two civil motor vehicle infractions, with which he was also charged. Clerk’s Hearing

During an excessively loud party at a friend’s apartment, Client was allegedly caught by the police providing shots of whiskey to his friends, all of whom were under 21 years old. After receiving a summons in the mail for a clerk magistrate’s hearing, Client hired the Yannetti Law Firm to try to prevent a complaint for Procuring Alcohol for Minors from issuing against him. Spousal Abuse
Client, a 50 year old man married man, was arrested for Domestic Assault and Battery. Client’s wife reported to the police that they had gotten into an argument over her opening his mail by mistake. The wife told the officers that as she was attempting to leave the garage, her husband pushed her out of the way and threatened to cut her throat. Client hired the Yannetti Law Firm to represent him. After months of investigation and negotiation, Attorney Tanis Yannetti persuades the judge and the prosecutor that the case should be dismissed today, on a pre-trial hearing date. The case is never scheduled for trial and is dismissed. Result: Case Dismissed.

Clerk’s Hearing
Client, an 18 year old high-school senior, faced a potential complaint for Malicious Destruction of Property and Threats. The police alleged that Client had been dating a 14 year old girl and was distraught when the relationship ended. The father of the 14 year old girl reportedly saw Client and two other males throw eggs on his car. The father also showed the police some threatening text messages that Client allegedly sent to the young girl. Client hired the Yannetti Law Firm to defend him. Prior to the hearing date, Attorney Tanis Yannetti contacted the father of the young girl to try to settle this matter without going forward on a clerk’s hearing. Restraining Order Hearing

Client, an 18 year-old high-school student, was dating a 14 year-old girl whose father did not approve of the relationship. After the father ordered him to not to contact his daughter, Client continued trying to pursue her. The father also alleged that Client had threatened him and thrown eggs at his car. As a result, the father obtained a temporary restraining order against Client. Client thereafter hired the Yannetti Law Firm to try to prevent a permanent restraining order from issuing against him. Today, at the final 209A restraining-order hearing, Attorney Tanis Yannetti negotiates a resolution with the father. Rather than face a hearing with an uncertain result, Client instead has the restraining order vacated. Result: Restraining Order Terminated.

Clerk’s Hearing
Client, a 26 year old law-school student, faced a potential complaint for Assault and Battery. On New Year’s Eve, Client allegedly was out celebrating at a bar with his girlfriend and other friends. Another man, a stranger to the group, repeatedly approached their table, trying to get the client’s girlfriend to accept a drink that he had bought for her. Client’s girlfriend repeatedly rejected his advances and told him that she was there with her boyfriend. The evening ended with a bar fight. The man who had approached their table claimed that Client had sucker-punched him and broke his nose. Client hired the Yannetti Criminal Defense Law Firm to represent him at his clerk magistrate’s hearing. After learning that the alleged victim obtained an attorney and was looking for a large sum of money to settle the case, Attorney Tanis Yannetti directed Client to go to the police station to make a cross-complaint for assault and battery. Today, at the clerk’s hearing, Attorney Tanis Yannetti persuades the clerk magistrate that Client was not the aggressor in the fight. Harassment Order Hearing

Client, a 41 year-old medical professional, was in the middle of a contentious divorce with his wife. Client’s mother-in-law applied for a harassment-prevention order, claiming that Client had been harassing her in connection with the divorce. Client hired the Yannetti Law Firm to represent him. Today, at the hearing, Attorney Tanis Yannetti persuades the judge that Client’s mother-in-law failed to meet the legal standard necessary for a harassment order. Drug Distribution

Client, a 37 year-old man, was arrested for Possession of a Class B Controlled Substance with Intent to Distribute. A state trooper pulled over Client’s car after discovering during a random license plate check that Client’s driver’s license was expired. After allegedly observing suspicious behavior, the trooper searched the vehicle and found a leather satchel — which Client admitted was his — containing six individual bags containing Methamphetamine. Client hired the Yannetti Law Firm to represent him. Today, after months of investigation and negotiation, Attorney Tanis Yannetti persuades the prosecutor to reduce the Possession With Intent Charge to simple Possession. Attorney Yannetti further persuades the prosecutor to recommend a one-year Continuance Without a Finding, with no conditions of probation. OUI/DUI charge
Client was arrested for Operating under the Influence of Alcohol and Minor in Possession of Alcohol. The police alleged that Client was driving down the Cape with a few friends in the early morning hours of the July 4th holiday. A police officer allegedly witnessed erratic operation and pulled them over. Client allegedly failed several field-sobriety tests. The officer found three six packs of beer in the back seat, as well as an open can of beer, half-consumed and cold to the touch. Once at the station, client agreed to take a breathalyzer and registered a .023 reading — nearly triple the legal limit. The client allegedly failed to blow into the tube correctly the second time, however, so the test was deemed to be a refusal. Client hired the Yannetti Criminal Defense Law Firm to fight the charges. Attorney Tanis Yannetti represented the client at his arraignment and promptly requested the police-cruiser video, as well as the booking video. Pursuant to Attorney Yannetti’s request, the judge ordered both videos to be preserved. As the case progressed, however, and after repeated attempts to obtain the recording, Attorney Yannetti was informed that the tapes had both been destroyed 30 days after Client’s arrest. Attorney Yannetti therefore drafted and filed a Motion to Dismiss the case. Today, the judge allowed the Motion to Dismiss the Operating Under the Influence Charge. Attorney Yannetti then negotiated a disposition of pre-trial probation for 3 months for the remaining charge of Minor In Possession of Alcohol. Result: Operating Under the Influence Dismissed, Minor in Possession of Alcohol Charge to be Dismissed.

Clerk’s Hearing
Client, a 26 year-old professional woman working at an investment banking firm, faced a potential complaint for Operating an Unregistered and Uninsured Motor Vehicle. The police pulled over Client’s car because after running her license plate, they allegedly learned that Client’s car had failed inspection. As a result, the car was allegedly not properly registered or insured. Client hired our firm to represent her. Today, at the clerk magistrate’s hearing, Attorney Tanis Yannetti presents the clerk with evidence that Client’s insurance policy was in fact active at the time of the stop. Violent Felony Charges

Client, a 24-year old engineer, was arrested for Assault and Battery by means of a Dangerous Weapon, two counts of Assault and Battery on a Police Officer, Assault and Battery, Disturbing a Public Assembly and Resisting Arrest. The police alleged that other patrons at the TD Garden were complaining because Client kept bumping into them and spilling her drinks on them. When a security officer asked her to accompany him, Client allegedly refused and shoved him in the chest. After being handcuffed, Client allegedly kicked two police officers with her boots, struggled with them and pounded her forehead into their chests. The police alleged that they had to physically carry her by her arms and legs down a long stairway. Client allegedly reeked of alcohol. After her arraignment in court the next day, Client hired the Yannetti Criminal Defense Law Firm to represent her. After a year of investigation and negotiation, Attorney Tanis Yannetti today persuades the prosecutor and the judge to place client on pre-trial probation for a year. As long as Client undergoes an evaluation regarding an alcohol problem, follows up with any recommended treatment, and performs 10 hours of community service, this case will be dismissed in one year. Client never admits any wrongdoing and retains the presumption of innocence. Result: Case Dismissed.

Theft Charge
Client, a 17 year-old high school student, was arrested for Larceny over $250.00, Vandalizing Property and Minor in Possession of Alcohol. The police alleged that Client, while under the influence of alcohol, damaged some skis at local resort and tried to steal other skis from the ski racks. While this case was pending in court, Client was arrested again for more serious crimes in the Concord District Court, which resulted in an in-patient hospitalization for mental health and substance abuse issues. Client’s mother hired the Yannetti Criminal Defense Law Firms for both cases, in two courts. Today, on the original Ayer District Court case, Attorney Tanis Yannetti successfully persuades the prosecutor and the judge to place Client on pre-trial probation. Client, a 14 year-old high school student, faced a CHINS complaint that had been filed by his school. The school alleged that Client required court assistance because of his repeated failure to obey school rules. The student was accused of a laundry list of inappropriate conduct in school. Police responded to his apartment after allegedly receiving information that one of the individuals within the apartment was dealing drugs. Client, a 26-year old college graduate with a master’s degree, admitted to sufficient facts on December 4, 2012 to the charge of Assault and Battery on Police Officer. He was sentenced to a two-year continuance-without-a-finding disposition. In early 2014, Client hired the Yannetti Criminal Defense Law Firm to file a motion to revise and revoke on his behalf, with the goal being a reduction in the length of his probation. Felony Theft Case
Client, a 33 year-old self-employed IT expert, was arrested for two counts of Receiving Stolen Property over $250 and one count of Conspiracy to Receive Stolen Property — all felonies. The police alleged that Client was regularly selling stolen laptops, computers and cell phones on Craig’s List. During one attempted sale, the police set up a “sting” operation, whereby the potential buyer identified Client, who was then allegedly caught in the act. Client hired the Yannetti Criminal Defense Law Firm to represent him as soon as he was bailed out from the police station. Our firm appeared with Client at his arraignment and also at many court dates over the course of several months. Client, a 51 year-old scientist, was arrested for Sex-for-a-Fee. The police alleged that Client had responded to BackPages.com ad for female companionship that was transparently advertising prostitution. Unbeknownst to Client, the Boston Police Human Trafficking Unit had placed the ad and lured Client to local hotel as a result. When Client appeared at the pre-determined meeting spot, he was placed under arrest and his cell phone was seized. Client hired the Yannetti Criminal Defense Law Firm shortly after he left the police station after being booked. Today, Attorney Tanis Yannetti appears with Client at his arraignment. Assault and Battery Case
Client, a 15 year-old boy, was summoned to court for an Assault and Battery charge. Outside a police station, Client allegedly struck his father during an argument over whether Client was carrying cigarettes. Client’s family hired the Yannetti Criminal Defense Law Firm to prevent any damage to Client’s juvenile record. Prior to his scheduled arraignment date, our firm filed a pre-arraignment motion to dismiss because the court failed to provide Client with a clerk magistrate’s hearing. Today, Attorney Tanis Yannetti persuades the judge to allow that motion and dismiss the case. Further, Attorney Yannetti provided enough information to the police and prosecutor to dissuade them from re-filing the charges. As a result, Client avoids any entry on his juvenile record. Motor Vehicle Charges
Client, a 34 year-old business owner and military veteran, was arrested for Negligent Operation of a Motor Vehicle and Leaving the Scene after Causing Property Damage. The police allegedly witnessed the Client in a fit of road rage. He allegedly slammed on the brakes to his car, got out and threatened to beat the driver behind him — who had apparently complained when Client had passed him on the wrong side of the road and scraped the door of his car. Client hired Attorney Tanis Yannetti of the Yannetti Criminal Defense Law Firm to represent him. At his arraignment, Attorney Yannetti filed a pre-arraignment motion for diversion pursuant to the Valor Act — a new statute authorizing certain military veterans to avoid arraignment and prosecution. After completing an anger-management course, Attorney Yannetti today persuades the prosecutor and the judge to dismiss both charges before arraignment. Domestic Violence Case
Client, a 24 year-old recent college graduate, was arrested and charged with Domestic Assault and Battery and Reckless Endangerment of a Child, a felony. The police alleged that Client became angry with the mother of his child after reading text messages on her phone. Client allegedly pushed her, pinned her down on the bed and punched her in the face. Violent Felonies / Motor Vehicle Charge
Client, a 19 year-old college student, was arrested for three counts of Assault by means of a Dangerous Weapon, one count of Assault and one count of Negligent Operation of a Motor Vehicle. The police alleged that Client — in front of other college students, who were willing to testify as witnesses — grabbed his girlfriend’s arm to prevent her from leaving him, then struck her in the chest. When leaving the scene, Client revved his tires, “did donuts” on the street, then drove his car directly at a bystander who had tried to come to his girlfriend’s aid. After being arraigned on those charges, Client was re-arrested six weeks later for Operating under the Influence of Liquor. The police alleged that Client once again was driving his car in circles in the parking lot of a school. Client allegedly also drove over a curb and onto a grassy area. When the police pulled him over, Client allegedly failed the field sobriety tests and failed the portable breathalyzer test. Client’s parents retained the Yannetti Criminal Defense Law Firm to represent him. Attorney Tanis Yannetti appeared at his arraigned on the new OUI case and persuades the judge not to revoke Client’s bail on the original Assault case. Attorney Yannetti then negotiates with two prosecutors in two different courts to reach a global resolution of all matters. Attorney Yannetti persuades the prosecution and judge in the Salem District Court to dismiss all three felony charges of Assault by means of a Dangerous Weapon. Client then receives a continuance-without-a-finding disposition on the two remaining misdemeanor charges for one year — concurrent with a one-year continuance without a finding on the OUI charge in Peabody. Result: Three Felony Charges Dismissed, Client Avoids Conviction on Remaining Misdemeanor Charges.

October 25, 2013
Theft Offenses
Client, a 28 year-old man from out-of-state, was charged with Larceny over $250, Uttering a False Instrument, and Identity Fraud. The police alleged that Client induced a Massachusetts woman to enter into a relationship with him, then used her credit card without authorization to purchase approximately $1,500.00 in goods and services for himself. The police produced as evidence e-mails between Client and his girlfriend wherein Client confessed to the crimes. Client hired the Yannetti Criminal Defense Law Firm to negotiate the best plea deal for him. After several months of dealing with a prosecutor who was insisting on a conviction, Attorney Tanis Yannetti today persuades the prosecutor and the judge to instead continue the cases without a finding of guilty for one year. Client, a 56 year-old man in a contentious relationship with his male domestic partner, was arrested and charged with four counts of Violation of a Restraining Order. The police alleged that after Client’s partner obtained a restraining order, Client tried to contact the partner through social media, through voicemail, through e-mail and through the cable company. Client hired the Yannetti Criminal Defense Law Firm to represent him. Attorney Tanis Yannetti thoroughly investigated the allegations and eventually scheduled the case for trial. Security footage showed them stealing hub caps, breaking windshield wipers, ripping off side mirrors and jumping up and down on car hoods. Client, a 53 year-old divorced executive who is the sole provider for her 13 year-old daughter, was arrested for Operating under the Influence of Drugs and Possession of a Class E Controlled Substance. The police alleged that Client was passed out behind the wheel of her car in a parking lot. As a result, the police applied to have Client’s driver’s license suspended because she was an alleged “immediate threat.” After being denied a hearing by the Registry of Motor Vehicles, Client hired the Yannetti Criminal Defense Law Firm to try to get her license back. Today, Attorney Tanis Yannetti persuades the Board of Appeals that Client’s license should be reinstated. Result: Client’s Driver’s License Reinstated.

Client, a 46 year-old woman whose husband had abused her for 5 years, applied for an emergency restraining order against him. Restraining Order Hearing
Client, a 34 year-old laborer, hired the Yannetti Criminal Defense Law Firm to represent him after a judge had issued a temporary restraining order against him — preventing him from contacting his wife and 5 year-old daughter. His wife alleged that Client had been physically and mentally abusive toward her and their daughter. Attorney Tanis Yannetti thoroughly investigated the allegations and arrived at the hearing with seven witnesses to rebut Client’s wife’s allegations. In court, Client’s wife promptly realizes that she did not have a case and withdraws the restraining order. Result: Restraining Order Dismissed and Client’s Parental Rights Restored.

Harassment Order Hearing
Client, a 54 year-old professional, contacted the Yannetti Law Firm because she was being harassed by her ex-boyfriend. She wanted a harassment order but was afraid of facing her ex-boyfriend’s bombastic lawyer without having representation herself. Attorney Tanis Yannetti, our restraining-order / harassment-order expert, took control of the case immediately. Attorney Yannetti helped Client to apply for the initial order, then represented her during a full and contentious hearing in court today. Felony Weapons Charges
Client, a 22 year-old non-citizen, was arrested for Assault by means of a Dangerous Weapon (a felony) and Carrying a Dangerous Weapon. The police alleged that in a road rage incident, Client pointed a BB gun at another driver. Client allegedly confessed to the police and the BB gun was recovered in Client’s car.
